We provide lists of books, resources, and links to other web sites for the user’s convenience. Listing of materials and resources on this web site should not be construed or interpreted as an endorsement by the Division for Learning Disabilities. The inclusion of links is not intended to endorse any views expressed on these outside sites, or the organizations sponsoring the sites. DLD does not control or guarantee the quality of content on sites external to TeachingLD.org.
Where TeachingLD.org provides intereactive opportunities, they are for the purpose of sharing information and resources. However, the DLD cannot verify the identity or good faith of those who post messages and does not necessarily endorse any of the opinions expressed on any of the discussion forums.
Terms of Use
Thank you for using the TeachingLD.org Web site. For both your protection and ours, we have established the following Terms of Use that we expect all visitors, whether members of the Division for Learning Disabilities (DLD) or otherwise, to follow while using our site. DLD has the right to change or discontinue any aspect or feature of TeachingLD.org, including, but not limited to, content, hours of availability, and equipment needed for access or use, at any time. Your use of TeachingLD (this site) means that you acknowledge these Terms and agree to abide by them at all times. Because we reserve the right to modify these Terms of Use at any time, please check them regularly. We will also notify you as described below if any material terms should change. Please note that you will be referred to as “User” from time to time in this Agreement.
GENERAL RULES
You agree and continue to agree to use our Web Site (further referred to as the Site) in a manner consistent with all applicable laws and regulations and in accordance with the Terms and Conditions set out in the policies and guidelines outlined below.
RULES OF CONDUCT FOR USE OF OUR DISCUSSION FORUMS AND OTHER INTERACTIVE AREAS
We are providing discussion forums and interactive areas in order for teachers and others involved with the education of students with learning disabilities to share information, experiences, and advice. We expect Users to engage in respectful conduct at all times. Behaviors that violate our standards and guidelines for use will not be tolerated. By continuing to use our Site, you are agreeing that you will not post any of the following material on any of our Discussion Forums or other interactive posting areas found at (or in) the Site:
- Advertising or any form of commercial solicitation
- Material that personally identifies a child or a student
- Material that is untrue, defames, abuses, harasses, or threatens others
- Statements that are bigoted, hateful, mean spirited, or ethnically or racially offensive
- Material that advocates illegal activity or discusses illegal activities with the intent to commit them
- Unauthorized copyrighted material (including, but not limited to, text, sound, or graphic files)
- Material that contains vulgar, obscene, pornographic, or indecent language or images
Statements or postings that violate the above terms or that we believe in our sole and absolute discretion should not be posted will be removed from the Discussion Forums upon discovery. Furthermore, such User will be responsible for all of our damages arising from such posting.
DOWNLOADING OF INTELLECTUAL PROPERTY
TeachingLD.org contains copyrighted material other proprietary information, including, but not limited to, text, software, photos, video, graphics, music, and sound. The entire contents of TeachingLD.org are copyrighted as a collective work/compilation. No User may modify, publish, transmit, participate in the transfer or sale, create derivative works, or in any way exploit, any of the content, in whole or in part. User may download one (1) single copy of the copyrighted material for User’s personal, non-commercial use only. Except as otherwise expressly permitted under copyright law, no copying, redistribution, retransmission, publication or commercial exploitation of downloaded material will be permitted without the express written permission of the Division for Learning Disabilities (or the copyright owner(s) if other than or in addition to DLD). In the event of any permitted copying, redistribution or publication of copyrighted material, no changes in or deletion of author attribution, copyright or other proprietary notice shall be made. User acknowledges that he/she does not acquire any ownership rights by downloading copyrighted material.
UPLOADING OF INTELLECTUAL PROPERTY
User shall not upload, post or otherwise make available on TeachingLD.org any material protected by copyright, trademark, or other proprietary right, without the express written permission of the owner of the copyright, trademark, or other proprietary right, and the burden of determining that any material is not protected by copyright rests with user. User shall be solely liable for any damage resulting from any infringement of copyrights, proprietary rights, or any other harm resulting from such a submission. By submitting material to any public area of TeachingLD.org, user automatically grants, or warrants that the owner of such material has expressly granted the Division for Learning Disabilities the royalty-free, perpetual, irrevocable, non-exclusive right and license to use, reproduce, modify, adapt, publish, translate and distribute such material (in whole or in part) worldwide and/or to incorporate it in other works in any form, media or technology now known or hereafter developed for the full term of any copyright that may exist in such material. User also permits any other user to access, view, store or reproduce the material for that user’s personal use. User hereby grants the Division for Learning Disabilities the right to edit, copy, publish and distribute any material made available on TeachingLD.org by user.
DISCLAIMER OF WARRANTIES
TEACHINGLD IS PROVIDED ON AN “AS IS” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF TITLE, NONINFRINGEMENT, OR IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. THE DIVISION FOR LEARNING DISABILITIES DOES NOT WARRANT THAT ANY INFORMATION IS COMPLETE OR ACCURATE, THAT TEACHINGLD WILL BE UNINTERRUPTED OR ERROR FREE OR THAT ANY INFORMATION IS FREE OF ROGUE PROGRAMMING.
LIMITATION OF DAMAGES
UNDER NO CIRCUMSTANCES, INCLUDING NEGLIGENCE, SHALL THE DIVISION FOR LEARNING DISABLITIES BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE OR CONSEQUENTIAL DAMAGES THAT MAY RESULT FROM THE USE OR INABILITY TO USE TEACHINGLD, INCLUDING WITHOUT LIMITATION USE OF OR RELIANCE ON INFORMATION AVAILABLE ON TEACHINGLD, INTERRUPTIONS, ERRORS, DEFECTS, MISTAKES, OMISSIONS, DELETIONS OF FILES, DELAYS IN OPERATION OR TRANSMISSION, NONDELIVERY OF INFORMATION, DISCLOSURE OF COMMUNICATIONS, OR ANY OTHER FAILURE OF PERFORMANCE.
RELEASE AND INDEMNITY
USER HEREBY RELEASES AND WAIVES ANY AND ALL CLAIMS AND/OR LIABILITY AGAINST THE DIVISION FOR LEARNING DISABILITIES ARISING FROM OR IN CONNECTION WITH YOUR USE OF TEACHINGLD. USER ALSO AGREES TO DEFEND, INDEMNIFY AND HOLD HARMLESS THE DIVISION FOR LEARNING DISABILITIES FROM AND AGAINST ANY AND ALL CLAIMS OR LIABILITY, INCLUDING COSTS AND ATTORNEYS FEES, ARISING FROM OR IN CONNECTION WITH YOUR USE OF TEACHINGLD OR FAILURE TO ABIDE BY APPLICABLE LAW.
